What Legal Pages Does My Website Need? (A Philippine Guide)

You've just perfected your custom web design. Your fonts are perfect, your colors pop, and your site is super-fast. But before you go live, there's a "boring" but critically important step that many Filipino businesses forget: the legal pages.

As a web developer in the Philippines, I am not a lawyer (and this is not legal advice!). However, I am responsible for implementing these pages, and I can tell you which ones are standard and why they are so important. They aren't just for "looking professional"—they are your first line of legal defense and are often required by law.

1. The "Privacy Policy" (This is Non-Negotiable)

What it is: A legal document that explains to your users what personal data you collect from them, how you collect it, why you collect it, and how you store and protect it.

Do you need it? YES. If your website has any of the following, you are legally required to have a Privacy Policy under the Philippine Data Privacy Act of 2012 (RA 10173):

• A "Contact Us" form (you collect names and emails).
• A newsletter sign-up.
• An e-commerce store (you collect addresses, phone numbers, payment info).
• Web analytics (like Google Analytics, which tracks user IP addresses).

In short, almost every modern website needs one. Not having one exposes your business to significant fines and builds massive distrust with your customers.

2. The "Terms and Conditions" (Your Website's Rules)

What it is: This is the "contract" or "rulebook" between you and your website visitors. By using your site, they agree to your terms.

Why it's important: This page protects you. It sets the rules and limits your liability. A good "Terms and Conditions" page includes:

• Intellectual Property: A clause stating that your logo, content, and design belong to you and cannot be stolen.
• Limitation of Liability: A legal statement that you are not responsible for any damages that may arise from a user's (mis)use of your site.
• Rules of Conduct: If you have a blog with comments or a forum, this is where you state that you can delete abusive or spammy content.
• E-commerce Rules: For online stores, this is where you put your refund policy, shipping policy, and payment terms.

3. Disclaimers (For Advice-Givers)

What it is: A short, specific statement designed to protect you from being sued for the advice you give.

Who needs one? You absolutely need a disclaimer if your website gives any kind of advice, especially in sensitive areas like:

• Finance or Investing
• Health and Wellness
• Legal or Tax Topics
• Fitness and Nutrition

A simple disclaimer like, "The content on this blog is for informational purposes only and does not constitute professional medical advice..." can be a legal lifesaver.

How to Get These Pages (Don't Copy-Paste!)

A common, and dangerous, mistake is to just copy-paste these pages from another website. Don't do it! Their terms might not apply to you, and it's a copyright violation.

• For Simple Sites: Use a trusted online policy generator (like Termly, GetTerms, or TermsFeed) as a starting point. They will ask you questions about your business and generate policies for you.
• For E-commerce or Complex Sites: This is the 100% best method. Hire a Filipino lawyer who understands the Data Privacy Act. The few thousand pesos you spend will be the best investment in your business's safety.

As your web developer, my job is to create the "Privacy Policy" page and link it in your website's footer as part of my launch checklist. But it is your responsibility as the business owner to provide the actual text. Taking this step seriously is a crucial part of digitizing your business properly.
